			<content:encoded><![CDATA[<p>On April 23, <a href="http://www.mwplegal.com/nathan-piwowarski">Nathan Piwowarski</a> will present &#8220;Capacity &amp; Older Patients&#8221; to the <a href="http://www.munsonhealthcare.org/munson/employment_volunteer/residency/residency.php" target="_blank">family practice residents of Munson Medical Center</a>. Nathan&#8217;s presentation will discuss the primary care physician&#8217;s role in probate proceedings, including guardianships, conservatorships, and will and trust contests. Nathan will also discuss the different forms of advance medical directives, and their role in health care decision making.</p>
<p>The presentation will draw from Nathan&#8217;s experience representing clients in numerous probate matters, including:</p>
<ul>
<li>Protective proceedings to authorize special needs plans and long-term care plans;</li>
<li>Contested guardianships;</li>
<li>Undue influence challenges to wills and trusts;</li>
<li>Testamentary capacity challenges to wills and trusts; and,</li>
<li>Breach of fiduciary duty claims against trustees, personal representatives, and agents acting under a durable power of attorney.</li>

		<description><![CDATA[Court of Appeals opinion adopting Jason Elmore's analysis of computer abuse statute cited by computer law treatise.]]></description>
			<content:encoded><![CDATA[<p>The treatise, <em>State Computer Law: Commentary, Cases &amp; Statutes</em> has included an annotation of <em><a title="People v Brunk" href="http://www.scribd.com/doc/19270914/People-v-Brunk-Michigan-Court-of-Appeals-opinion" target="_blank">People v Brunk</a></em>, a Michigan Court of Appeals opinion  in favor of criminal defense attorney <a title="Jason J. Elmore" href="http://www.mwplegal.com/?page_id=77" target="_self">Jason Elmore</a>&#8217;s client. Jason&#8217;s client was a State of Michigan computer and radio technician charged with felony and misdemeanor unauthorized computer network access.</p>
<p>At trial, Elmore challenged the state&#8217;s interpretation of Michigan&#8217;s &#8220;computer abuse&#8221; statute, MCL 752.795. Elmore reasoned that, before an employee using a computer network can be convicted of making an &#8220;unauthorized&#8221; access, the employer must set rules and procedures outlining what types of network access are allowed.</p>
<p>After a jury trial, Jason&#8217;s client was acquitted of the felony charge, but convicted of the misdemeanor. The Court of Appeals <a title="People v Brunk" href="http://www.scribd.com/doc/19270914/People-v-Brunk-Michigan-Court-of-Appeals-opinion" target="_blank">reversed our client&#8217;s conviction</a>, agreeing with Jason&#8217;s analysis at trial.</p>
